Listed below are our membership terms and conditions for our Webstar's Swim School.
All terms and conditions have been created to ensure the safety and enjoyment of patrons at all times. These also ensure fair and equitable conditions for all using our centres.
Please discuss these terms and conditions with any Swim Sport & Leisure staff member if you require advice, guidance or clarification.
It’s important to note that the following information is subject to change. In the event of updates or amendments, you will be notified by your centre or through other communications such as a letter, phone call, email or text message.
Please make every effort to familiarise yourself with this information and refer to it when required.
1.1 The following are the terms and conditions on which the City of Greater Geelong (referred to as we, us, our) offers membership in Webstar's Swim School to a student (referred to as the student) nominated by you (referred to as you, your). Conditions of entry on display at our centres also apply.
1.2. You must be over the age of 18 years to enter into this agreement. You may nominate as the student a person under the age of 18 years of whom you are the parent or guardian, in which case you agree that you are bound by these terms and conditions personally and on their behalf.
2. Lessons and pool access
2.1. Swimming lessons are held each week of the year, excluding public holidays and a two week break at Christmas. Details of the dates on which lessons will and will not be held are published in the Swim School calendar.
2.2. At enrolment, the student will be allocated a class day and time depending on availability and the student’s level of swimming skill. It may be necessary for us to make changes to the class time or teacher from time to time.
2.3. The student is entitled to unlimited swim entry at any Swim Sport & Leisure Centre (Leisurelink, Splashdown, Waterworld, Bellarine Aquatic & Sports Centre, Kardinia Aquatic Centre and Lara Pool) while their membership is active at no extra charge. The student’s membership card will scan to allow entry.
3.1. Our Swim Sport & Leisure Centres are accredited Watch Around Water facilities and to ensure the safety of students we require you to comply with the following conditions.
3.2. In this clause:
3.2.1. Supervising Adult means you or an adult nominated by you on your behalf who is at least 16 years of age and who has been made aware by you of these terms and conditions;
3.2.2. Supervise for the purposes of clause 3.4 means to maintain a constant physical presence and availability to meet the needs of the student.
During a swimming lesson
3.3 Before and after a lesson the Supervising Adult will be responsible for the student’s safety. During a lesson, the Supervising Adult and the teacher will share responsibility for the student’s safety in accordance with this clause.
3.4 You agree to ensure that during a swimming lesson provided by us:
3.4.1. if the student is under 3 years of age, the Supervising Adult constantly and actively Supervises, and remains in the water and within arm’s reach of, the student. The Supervising Adult may enter the pool at no charge;
3.4.2. if the student is between 3 and 10 years of age, the Supervising Adult Supervises the student, remains in the pool hall, maintains all necessary visual contact with the student and is easily contactable by the teacher;
3.4.3. if the student is over 10 years of age, the Supervising Adult Supervises the student to the extent appropriate to their swimming ability and general development.
At other times
3.5 You agree to ensure that at all other times when the student is around water at our Centres (including before and after a lesson):
3.5.1. if the student is under 5 years of age, the Supervising Adult must accompany the student into the centre and the water and must remain within arm’s reach of the student. The Supervising Adult may enter the pool at no charge;
3.5.2. if the student is between 5 and 10 years of age, the Supervising Adult must accompany the student into the centre, must be located near the student, and must position themselves to have a clear view of the student with no physical or structural barriers between them and the student.
3.5.3. if the student is over 10 years of age, the Supervising Adult must use their knowledge of an individual student’s swimming ability and general development to determine the level of supervision required.
4.1. You must pay membership fees by direct debit from your nominated bank account or credit account (Visa Card or Mastercard). We debit payments fortnightly on a Wednesday (or if a debit falls on a day that is not a banking day, the next banking day) in advance for the next fortnight, and will continue to do so until you cancel or suspend the student’s membership. You agree that membership fees will be debited whether or not the student attends lessons.
4.2. If a direct debit payment is unsuccessful, you must make payment by other means as soon as possible. The student’s access to our Centres will be restricted until the outstanding amount has been paid.
4.3. If you have multiple students enrolled in Webstar’s Swim School, your account will be debited separately for each student.
4.4. We may vary membership fees by providing you with 30 days written notice.
4.5. Concession membership fees are available to holders of a current Blue PensionCard, DVA Gold Card, Health Care Card, Commonwealth Seniors Health Care Card, apprenticeship identification or a full time Student Card. To qualify for concession membership fees you must present your concession card and current photo identification at the time of joining and at any time upon request by us.
5.1. We assess each student’s progress on an ongoing basis and you may request an assessment of your student’s skills at any time.
5.2. If a student who is enrolled in Courage (3-5 years) or Active (school age) classes has remained in the same level for 30 consecutive weeks or more, and has attended at least 27 of the previous 30 scheduled lessons, the student is eligible for additional support upon request. This excludes Squad, Parent and Toddler and Accessibility lessons.
6. Credit for missed lessons
6.1. If we cancel a lesson due to unforeseen circumstances at the Centre, we will issue you with a credit for the swimming lesson to be applied to a future direct debit.
Illness or injury
6.2. We will issue a credit in accordance with this clause for each lesson missed by a student due to illness or injury.
6.3. To claim a credit, you must submit to reception staff within one (1) month of the missed lesson a completed Credit Request Form (available from reception staff at all Centres) with a medical certificate issued by a medical practitioner registered by AHPRA that states the student’s name and that the student was ill or injured on the date of the missed lesson.
6.4. Credit will be applied to a future direct debit. Each credit will be valid for six (6) months from the date of issue. No refund will be provided for unused credits.
7. Suspension of lessons
Suspension for illness or injury
7.1. You may suspend future lessons and direct debits due to an illness or injury suffered by the student for the period of the illness or injury.
7.2. To request a suspension, you must submit to reception staff a completed Suspension Form (available from reception at all Centres) with a medical certificate issued by a medical practitioner registered by AHPRA that states the student’s name and the period of illness or injury. Verbal requests will not be accepted.
7.3. Access rights to all Centres will be suspended during the suspension period. Membership and direct debit payments will recommence on the return date specified on the suspension application form, and wherever possible we will place the student in the same class as before the suspension.
Suspension for other reasons
7.4. You may suspend future lessons and direct debits for a reason other than illness or injury in blocks of two (2) or four (4) weeks.
7.5. Suspensions must not exceed a total of four (4) weeks per year of membership (and no more than four (4) weeks in any 12 month period under any membership for the student). Unused suspension allocation cannot be accumulated for use in the future, or transferred to another member.
7.6. To request a suspension, you must submit to reception staff a completed Suspension Form (available from reception at all Centres). Verbal requests will not be accepted. A minimum of one (1) payment period’s written notice is required. Suspensions cannot be backdated. A suspension request will not be accepted unless all payments for the student are up to date.
7.7. Access rights to all Centres will be suspended during the suspension period. Membership and direct debit payments will recommence on the return date specified on the suspension application form, and wherever possible we will place the student in the same class as before the suspension.
8. Cancelling membership
8.1. We offer a 7 day cooling off period from the date of joining, during which you may cancel the student’s membership immediately by notifying us in writing.
8.2. You may cancel the student’s membership at any time by giving us one (1) payment period’s notice. If you provide less than one (1) payment period’s notice, one further direct debit payment will be processed against your account.
8.3. To cancel the student’s membership, you must submit to reception staff a completed Cancellation Form (available from reception staff at all Centres). Any outstanding amount must be paid upon cancelling your membership.
8.4. The student will have access to Swim Sport & Leisure Centres for two weeks following the final direct debit payment.
8.5. We may cancel the student’s membership with 28 days’ notice, or at any time if you or the student fail to comply with these terms and conditions or the conditions of entry displayed at our Centres.
9. Your details
9.1. It is your responsibility to inform the Centre of any change to your contact and banking details. Forms are available from reception staff at all Centres. To ensure the confidentiality of your details and the accuracy of our records, any change must be made in person at one of our Centres.
10. Swim nappy use
10.1. Students who are not yet toilet trained must wear a suitable swim nappy while swimming. Please see reception if you would like to purchase a disposable waterproof nappy.
11. Membership card
11.1. The student’s membership card must be presented at each visit to gain entry to our facilities.
11.2. The student’s membership card remains our property at all times. Membership cards are not transferable. A small fee will be charged for the replacement of a lost membership card.
12. Closure of facility
12.1. Management reserves the right to close any facility or part of a facility at any time for urgent maintenance or upgrades. We will make reasonable efforts to notify you of the closure.
13.1. We may change these terms and conditions at any time by providing you with at least 28 days written notice. If you wish to cancel your membership as a result of the changes, you may do so as set out in these terms and conditions.
14.1. You warrant that the student has no medical condition that may affect their ability to participate in swimming lessons except as disclosed on the Membership Application. If the student does have such a medical condition, you warrant that the condition has been assessed by a medical practitioner registered by AHPRA who has advised that it is safe for the student to participate in the swimming lessons and related services we offer.
14.2. You consent to the student receiving emergency medical treatment in the event of injury or illness while at a Swim Sport & Leisure Centre.
15.1. Although we take all reasonable care in providing swimming lessons and related services, you acknowledge that these activities involve inherent risks. To the maximum extent permitted by law, you and the student expressly release us and our staff from all claims and demands (including in negligence) arising from your or the student’s participation in activities under this agreement or use of our facilities, including but not limited to personal injury or property damage or loss.
Around our pools, spas, saunas and water play areas:
- We are an accredited Watch Around Water facility meaning there are guidelines that must be followed when visiting our pools. Please refer to the General Admission sign, pool signage or speak to any staff member.
- Rules relating to all aquatic facilities and activities must be adhered to at all times.
Webstar's Swim School guidelines
The following guidelines apply to each student enrolled in Webstar’s Swim School.
By enrolling, you acknowledge and accept the below guidelines.
If your child is unwell or suffering from the following contagious symptoms and illnesses, flu, cold, fever, diarrhoea, vomiting, gastro, head lice or sore throat, please consider your child(ren), staff and other participants and do not bring your child to lessons.
In the event of sickness, a credit will be issued if accompanied by a Doctor’s Certificate.
Gastro: Please do not bring your child to the swimming pool for 14 days after symptoms have ceased.
Teacher and class changes
While we strive to provide your child with a consistent teacher and class, at times this is not possible due to unavoidable circumstances.
Management reserves the right to:
- Cancel your membership and refuse entry to any person not adhering to the City of Greater Geelong Swim Sport & Leisure Membership Terms and Conditions.
- Close any facility, or part of, at any time for urgent maintenance or upgrades. Every effort will be made to communicate closure to members.
