We have conditions of entry that apply when you visit any of our Swim, Sport and Leisure centres.
All terms and conditions have been created to ensure the safety and enjoyment of patrons at all times. These also ensure fair and equitable conditions for all using our centres.
Please discuss these terms and conditions with any Swim, Sport and Leisure centre staff member if you require advice, guidance or clarification.
It’s important to note that the following information is subject to change. In the event of updates or amendments, you will be notified by your centre or through other communications such as a letter, phone call, email or text message.
Please make every effort to familiarise yourself with this information and refer to it when required. Should you not wish to comply with these conditions of entry, we may remove or refuse entry.
Conditions of entry
- We will not tolerate:
- offensive, aggressive, or sexually inappropriate language or behaviour
- misuse or intentional damage of our facilities
- animals (except guide dogs)
- smoking, alcohol or drugs
- unsolicited photos or videos.
- Please take note of signs, our Code of Conduct and follow staff directions.
- Observe specific conditions that apply to the entry you’ve purchased.
- Minimum ages and supervision of children:
- Children under 10 years of age must be supervised by a responsible person at least 16 years of age.
- Minimum 12 years of age for group exercise or gym. Those aged from 12-15 in the gym must be supervised by a responsible person at least 16 years of age.
- Minimum 16 years of age for the use of spa or sauna.
- Follow Watch Around Water guidelines.
- You consent to receiving emergency medical treatment if you are ill or injured at our centre, and you must pay, or reimburse us for, any associated medical expenses.
Watch Around Water
You must actively supervise your children around water at all times. You must keep children under 5 years of age within arms’ reach. You must keep children under 10 years of age in sight.
We may remove your child from the water if we consider that you are not complying with these requirements or the child is at risk in the water.
Exclusion of liability under Australian Consumer Law
Activities you may participate in using our facilities and services may involve a significant degree of physical exertion and/or physical risk, which may lead to injury to you or your death.
Warning under the Australian Consumer Law and Fair Trading Act 2012
If you participate in these activities your rights to sue the supplier under the Australian Consumer Law and Fair Trading Act 2012 if you are killed or injured because the activities were not supplied with due care and skill or were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in or on this sign.
Note: The change to your rights, as set out in or on this sign, does not apply if your death or injury is due to gross negligence on the supplier’s part. Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2012 and section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012.
To the maximum extent permitted by law, you agree that we and our staff are not liable to you for any injury or death you suffer because of any breach of the consumer guarantees in the Australian Consumer Law, including the guarantees that services be rendered with due care and skill, and that they be reasonably fit for purpose. The exclusion of liability in this clause does not apply to the extent that you have suffered any significant personal injury that was caused by our reckless conduct. In this clause:
- Injury means:
- a physical or mental injury of an individual (including the aggravation, acceleration or recurrence of such an injury of the individual) or
- the contraction, aggravation or acceleration of a disease of an individual or
- the coming into existence, the aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs in relation to an individual that is or may be harmful or disadvantageous to the individual or community, or that may result in harm or disadvantage to the individual or community;
- significant personal injury and reckless conduct have the same meanings as in section 139A of the Competition and Consumer Act 2010 (Cth);
Exclusion of other liability
To the maximum extent permitted by law, and subject to the Australia Consumer Law, you agree that we and our staff are not liable for any claim (including in negligence or for breach of any implied term, condition or warranty) arising from your use of our facilities or services, including but not limited to:
- injury or death or
- loss or damage to property (including any personal property you bring to or leave at our facilities or in a locker at our facilities).
