Broderick Road recycling site

In 2013 the City of Greater Geelong issued a temporary planning permit for a materials recycling facility at 300-400 Broderick Road, Lara.

In 2016, despite the City’s opposition, the site operator successfully sought VCAT’s direction for a planning permit to be issued for the ongoing use of the site as a materials recycling facility.

The site operator has repeatedly breached planning permit conditions and orders made by the Victorian Civil and Administrative Tribunal in relation to the operation of the site.

As well as enforcement action at VCAT, criminal charges have been brought against the site operator and its director, David McAuliffe, on a number of occasions.

In December 2015, Mr McAuliffe was found guilty of breaching an enforcement order issued by VCAT in January 2015.

In November 2016, Mr McAuliffe was found guilty of breaching the temporary planning permit.

Further charges against Mr McAuliffe are scheduled for hearing on 14 and 15 November 2018, relating to charges of breaching an interim enforcement order issued by VCAT in December 2017.
