Background

Following significant interest and concerns raised by the community, Council made a decision at the end of March to apply to cancel the planning permit issued to Nuchev for its proposed goat farm development at Lara.

The City's application to cancel the planning permit issued to Nuchev Pty Ltd for a proposed goat farm development at Lara, was lodged with Victorian Civil and Administrative Tribunal (VCAT) on 9 May 2018.

29 June 2018

The Victorian Civil and Administrative Tribunal (VCAT) has cancelled the planning permit for a proposed goat farm development at 240 Forest Road South, Lara.

A number of representatives of the Lara community were in attendance to witness the outcome of the VCAT practice hearing, which achieved the Council’s resolution from March to proceed with the application to cancel planning permit 1204-2015.


27 June 2018

Nuchev and the Council have agreed to ask VCAT to cancel the planning permit for a goat farm at 240 Forest Road South, Lara.

Today, Wednesday 27 June 2018, Nuchev and the City filed consent orders with VCAT asking for the planning permit to be cancelled.

A Practice Day Hearing is set with VCAT for this Friday, 29 June 2018, when the City and Nuchev Pty Ltd will confirm with VCAT that an order to cancel the permit will be made.

People who have filed a Statement of Grounds and who have paid a fee to VCAT are parties to the proceeding and must attend VCAT on Friday to formalise their consent for the cancellation of the Permit.

Our application to cancel the planning permit issued to Nuchev Pty Ltd for a proposed goat farm development at Lara, was lodged with Victorian Civil and Administrative Tribunal (VCAT) on 9 May 2018.

Dates have now been set by the VCAT for a Practice Day Hearing on 29 June 2018 and a Final Hearing on 19 November 2018 (for five days).

How can I participate in the proceedings?

Our application to VCAT to cancel the planning permit issued to Nuchev Pty Ltd for a proposed goat farm development at Lara, lists No Nuchev Inc and Neil Longmore, Lawyer, as interested parties to the proceedings. 

Other people are able to participate in the proceedings.  

People who aren’t already a party to the proceedings but who wish to participate in the proceedings can do so in two ways:

  1. By joining the No Nuchev Inc group, which intends on filing a statement of grounds on behalf of its members in the proceedings. If you wish to become a member of No Nuchev Inc you may contact the organisation by email NoToNuchev@gmail.com ; or
  2. By filing a statement of grounds personally. A copy of the statement of grounds form can be found on the VCAT website.

Filing a statement of grounds does not automatically make you a party to the proceeding, and you may choose whether or not you become a party. If you choose not to become a party to the proceedings, but still file a statement of grounds, VCAT may consider any issues you outline in the statement of grounds when it considers the merits of the application. 

Information about becoming a party to a VCAT proceeding, and the rights and obligations of doing so can be found on the VCAT website.

No fees apply to a statement of grounds filed by a person who does not wish to participate in the hearing. Those people wanting to participate in the hearing will need to pay a fee when filing their statement of grounds. View fee information.

City of Greater Geelong drop in session 

We will hold a drop is session this Thursday 21 June between 5:30pm and 7:30pm at the Senior Citizen’s room at the Lara Hall, Forest Road North, Lara.  At this session copies of the VCAT guides and forms will be available.

If you can’t make this session, the forms and guides will also be available at the City of Greater Geelong Corio Customer Service Centre located in Corio Central Shopping Centre, from Thursday 21 June 2018.
