Nominate a driver or request a court hearing in relation to a fine

We need to know if someone else was in possession of your vehicle at the time the infringement was issued. The registered owner of a vehicle may submit a Nomination Statement (the legal document used to nominate a driver).

In the top right-hand corner of the form, you will need to provide your:

  • infringement number
  • vehicle registration
  • offence date and
  • offence time.

There are two sections to this form. Please complete either the Nomination Statement section or the Request a court hearing section.


Nomination Statement

Parking infringement notices are issued directly to the registered owner. Owner details are sourced from the VicRoads Vehicle Registration Database.

The registered vehicle owner is responsible for all parking infringements issued to their vehicle. Please note you do not lose demerit points for parking infringements.

If you were not the driver at the time of a parking offence, you can nominate the responsible driver which transfers the liability of the infringement to them.


Please note: You cannot sign a nomination statement where you have been nominated. If you are the director of a company and you wish to nominate yourself for a company vehicle, please have an administration or fleet officer complete the nomination form. If another staff member cannot sign the nomination statement, you will need to provide proof you are the director of the company in order to accept the nomination form.


There are four parts to this section. Depending on the answer to A, you will be directed to the next part. Complete each part in sequence, as directed:

  1. Select the circumstance that best describes why you were not in possession of the vehicle at the time of the infringement:
    • Someone else was the driver in possession or control of the vehicle at the time of the alleged offence - go to B
    • I sold this vehicle to someone else or permanently disposed of the vehicle on this date (enter date) - go to B
    • I believe the vehicle or number plates displayed on the vehicle were stolen. Note: you must attach a Police Report or Reference Number - go to D
    • I do not know and cannot identify the person in possession of the vehicle at the time of the alleged offence. Note: this statement cannot be selected where the alleged offence involves a taxi-cab - go to C
    • I was incorrectly nominated as the responsible person in relation to the vehicle and I reject the nomination.
  2. If directed to this section after making your choice in section A, you will need to provide details of who was in possession of the vehicle at the time of the alleged offence
  3. You will need to tell us what you have done to identify the driver, if you are directed to answer this question after section A
  4. Confirm the name and address of the person/company named in the infringement notice. Your signature and date are required to complete the section.

Request a court hearing

If you have received an infringement notice, you may elect to have a matter heard at the Magistrates Court. If you disagree with the outcome of your internal review, your remaining option is to have the matter heard at the Magistrates’ Court.

Before you submit your court request, you must ensure you are the registered owner or person/company listed on the infringement notice.

If you were the driver and haven’t been formally nominated, the registered owner of the vehicle must complete the nomination form. Once you have been nominated, the infringement notice will be re-issued in your name and you will receive the infringement. You can then take action to resolve your fine (like requesting a review or electing to go to court).

A lawyer can act on your behalf, or company, named on the infringement notice. Ensure a letter of consent is provided.

Please note that the City of Greater Geelong incurs costs as part of this process, and we seek to recover these costs providing the court finds the matter proven.
