Use of online services
You may use information provided to you through City of Greater Geelong online services, solely for your personal and/or internal business purposes, provided that you do not remove any proprietary rights notices, modify the information, or make it available to any third parties.
In using online services, you declare that you are over 18 years of age and have legal capacity to contract in Australia.
If you are using a credit card to process a transaction, you declare that the credit card is issued in your name and that you will pay to the issuer all charges incurred using online services.
If you are using a City of Greater Geelong account, you declare that you are authorised to use the login and password allocated to such account.
You may request that certain documents be treated as confidential. However, the final discretion lies with Council.
Collecting your information
By using online services, you agree to provide any relevant information, documents and attachments in the format and to the standards described for each transaction.
You also acknowledge that the information collected will be retained in electronic form.
Where information is requested by a third party, the requesting party is deemed to be the recipient's agent and is presumed to have obtained the consent of the recipient to receive the information in electronic format.
Certain online services offered by the City may require a login and password for verification of your identity.
You agree that all information provided to the City by you in relation to your account shall be accurate, current and complete.
We recommend you select a password that does not relate to any readily accessible data such as your name, date of birth, address, telephone number, driver's licence, licence plate or passport.
It is also recommended that the combination of letters and numbers is not obvious and does not include sequential or repeated numbers or letters.
You are solely responsible for maintaining the security of your login and password, and for all activity which occurs on or through your account, whether authorised or unauthorised. You should change your password immediately if you believe that your login or password has been used without authorisation.
The City accepts no liability for your failure to comply with these obligations.
Online services are provided through a secure website [using SSL (secure socket layer) encryption].
However, you acknowledge that internet transmissions are never entirely secure or private, and that any message or information you send to or through the website (including credit card information) may be read or intercepted by others, even where a website is stated to be secure.
The City accepts no liability for the interception or ‘hacking' of data through the website by unauthorised third parties.
Accuracy of transaction information
Upon completing a transaction using online services, you will be presented with a confirmation screen verifying the transaction details you wish to process. It is your responsibility to verify that all transaction, credit card/account information and other details are correct.
You should print the transaction confirmation for future reference and for your files.
The City accepts no liability for transactions which are incorrect, or for loss of data or information caused by factors outside of the City's control.
Limitation of liability
Except as expressly provided by law, the City accepts no liability whatsoever for any liability, loss, damage or expense incurred or suffered as a direct or indirect result of the use of Online Services.
The liability of the City to make any payment (by way of indemnity, damages or otherwise) is limited to the dollar amount of the transaction forming the basis of the damage, or $100, whichever is less.
You agree that any dispute in relation to your use of the website will be governed by the laws of Victoria, and shall be determined in that jurisdiction.
Right to suspend, alter or cancel service
The City may, at any time, without prior notice or without incurring any liability to you, cancel or suspend any or all online services and/or substitute alternative services, which may or may not be interactive or transactional in nature.
Specific service terms and conditions
You acknowledge that any online services made available by the City may be subject to specific additional terms and conditions, and you agree to review and comply with those terms and conditions.
Access to and use of any online service shall be deemed to constitute acceptance of the additional terms and conditions applicable to such services.
