Notice of Abandonment - Amendment C436ggee

This Notice has been prepared in accordance with Section 28 (2) of the Planning and Environment Act 1987.

The Greater Geelong City Council has resolved to abandon Amendment C436ggee to the Greater Geelong Planning Scheme.

The amendment proposed to amend the Comprehensive Development Zone Schedule 2 and the Rippleside Comprehensive Development Plan February 2000 and Rippleside Urban Design Guidelines June 2000 Incorporated Documents to facilitate the Balmoral Quay Stage 5 development in Rippleside.

The amendment was a combined planning permit application and planning scheme amendment under section 96A of the Act. Planning permit application PP-573-2021 sought approval for buildings and works for the purpose of a seven-storey apartment building containing 84 dwellings, office and retail premises and a reduction in the car parking requirements of Clause 52.06.

The amendment lapsed on 26 July 2024 when the Council, as planning authority, notified the Minister in writing that it has abandoned the amendment.

At its meeting on 23 July 2024 Council passed the following resolution:
That Council:

1. Abandon Amendment C436ggee due to concerns with the building scale and height and traffic and access issues; and

2. Tell the Minister for Planning in writing that the amendment is abandoned; and therefore, in accordance with Section 96G(2) of the Planning and Environment Act 1987, advise that Council cannot recommend to the Minister for Planning that Planning Permit 573-2021 be granted.

The decision to abandon the Amendment was made by Council at it’s Council Meeting 23 July 2024.
