1) Application for Use
The application for use shall be:
- Made on the form approved and supplied by the City of Greater Geelong on behalf of Simonds Stadium (The Venue).
- Signed by the Hirer or their authorised representative desiring use of the Venue.
2) Permission to Use the Facility
Permission to use any facilities may be granted by the Venue Manager or Operations Coordinator on behalf of the City of Greater Geelong.
It shall be at the discretion of City of Greater Geelong to deny use of any venue facility. Notwithstanding, if a facility has been hired, conditions of
such agreed and deposit and/or bond paid; the Council shall, if deemed necessary, cancel any such agreement and return all monies paid. The Hirer
agrees to accept such decision and to have consented to such cancellation, and to have no claim at law or in equity for any loss or damage in consequence thereof.
3) Bookings
All bookings are considered tentative until the completed application form and applicable deposit/bond have been received and confirmed in writing by the Venue Manager.
4) Charges
All charges for the facilities will be determined by the Venue Manager on behalf of the City of Greater Geelong, and may vary from time to time.
An account for all associated costs will be forwarded within 30 days of the event.
5) Hirer’s Responsibilities
The Hirer has made all reasonable inquiries as to the suitability of the facility for the proposed event or use.
The Hirer must –
a) Remain on the premises whilst visitors/patrons are in the facility.
b) Be responsible for orderly conduct and safety of patrons.
c) Maintain the premises in a clean and safe condition for the duration of hire.
d) Supervise all people at the facility at all times
6) Legal & Copyright Requirement
The hirer shall comply with all requirements of the Health Act, Local Government Act, APRA, Liquor Licensing Victoria or any other applicable
regulations. Failure to conform will render the hirer liable for any breach.
7) Decorations
Decorating is the responsibility of the Hirer. No signs, banners, streamers etc. are to be nailed, screwed, stapled or adhered to any surface
within the venue. Signage can be installed upon approval of the Venue Manager. The use of confetti or similar items is prohibited. Additional
charge may apply for the removal of excessive decoration.
8) Free Access
Simonds Stadium Management and staff shall at all times, notwithstanding any hirings, be entitled to free access to all areas of the venue.
9) Damage
The floors, walls, ceilings, curtains or any other part of the facility, or any furniture or fittings shall not be broken,
pierced by nail, pins, screws or in any other way damaged. No signs, notice, advertisement etc. shall be erected in the venue or
attached to or affixed to the walls, doors or any other part of the facility without the prior consent of the Venue Manager or
Operations Coordinator. Likewise, all furniture, fittings and equipment should be kept in good working order. Any damage to the
building, furniture, fittings or equipment shall be reported to the Duty Supervisor immediately it occurs. The Hirer may be held responsible
for repairing/replacing any damage to the venue or to furniture, fittings or equipment.
10) Good Order
The Hirer shall be responsible for the full observance of these conditions and for the maintenance and preservation of good order within the
facility and in the approaches thereto, throughout the duration of the hire.
11) Security Services
The Venue Manager reserves the right to request external security for any event. Any fee applicable to such engagement shall be the onus of the Hirer.
12) Egress
The Hirer shall comply in every respect to regulations under the Health Act, with regard to public buildings for the prevention of overcrowding,
obstruction of gangways, passages, corridors, doorways, emergency exits or any other part of the facility allowing the safe movement of people within the facility.
13) Smoking Policy
In the interest of public health and in line with Government Regulations, Simonds Stadium is a Smoke Free venue.
14) Noise & Amenity
The Hirer shall not cause or permit undue detriment to the amenity of the area to arise out of or in connection with the use of the facility during
or immediately after the event. The Hirer shall ensure that the level of noise emitted from the premises shall not exceed:
- The permissible noise level for mechanical equipment as specified in the State Environment Protection Policy N1 and
- The permissible noise levels for entertainment noise as specified in the State Environment Protection Policy N2.
No electrically amplified musical equipment shall be used after 11.00pm. Any breach of this time restriction or the Government Acts may result in forfeiture of the security bond.
15) Liquor
Simonds Stadium is a fully licensed venue and as such prohibits the bringing onto the premises of any alcoholic beverages.
16) Insurance
The Hirer must hold and provide evidence of current Public Liability Insurance cover of not less than $10,000,000.00 for death,
personal injury, loss and damage to property. Evidence of such insurance must be held by the Venue Manager for the duration of the event.
17) Indemnity
The Hirer agrees to indemnify and keep indemnified and to hold harmless the City of Greater Geelong, its servants and agents and each of them
from and against all actions, costs, claims, charges, expenses, and damages whatsoever which may be bought or made or claimed against it or
any of them arising out of or in any way related to the granting of the application and/or the use of the venue.
The City of Greater Geelong is not responsible for any theft, loss, damage or injury suffered by the Hirer or any guest or invitee of the hirer,
or any person coming on the premises during the period of hire, and the Hirer indemnifies the City of Greater Geelong in respect of all claims for
loss, damage or injury caused by any person or property during the period of hire, or as a result of the use by the Hirer of the facility.
